Iako su sudovi bili dužni provjeriti jesu li posvojitelji upisani u Registar posvojitelja u Hrvatskoj, kako piše Jutarnji, to nisu učinili nijednom.

Children for Sale: Croatia’s Corrupted Institutions Have Blessed Illegal Adoptions

Croatia has shown no willingness to investigate the transnational organized crime of illegal adoptions from DR Congo and has, on the contrary, assisted it.
The illegal adoption of African children that took place throughout Croatia, with the blessing of the government, has opened another perspective towards that new member of the Schengen zone.
The lack of political will in Croatia to carry out an investigation has given the impression that employees of public institutions might be involved in organized crime and that the case of illegal adoption was being covered up.
A crime that may implicate a network of Croatian bureaucrats came to light in December last year, when immigration officers at Zambia’s Ndola airport detained eight Croatian citizens on suspicion of child trafficking and falsification of documents. A Congolese lawyer who was an intermediary in issuing false adoption documents was also arrested and has admitted that everything took place outside the rule of law.

My source from the illegal adoption network was convinced that the arrested Croats would be released, and claimed that the organization that profits from 15,000 to 40,000 euros per child is too powerful and too well organized.

Trade in children done with public money

A Croatian diplomat, “a person from some old structures”, meanwhile came to assist with the matter to free them. A mediator is usually sent in such cases. For ambassador Tomislav Bosnjak, the role of the translator was just a cover for an operation to negotiate with the Zambian authorities to release the Croatian citizens, even if they were found guilty.

He was sent at the right time because he could reach an agreement before the judgment is pronounced. This usually works on the principle of trade, i.e. exchange. In order for eight Croatian citizens to return freely to their home country, perhaps the Zambian authorities could ask for the release of a Zambian citizen in a Croatian prison, or for some flour to be sent to Zambia, or that some of their products must be placed in Croatian stores.

According to conversations within diplomatic circles, it seems that the eight unconvicted Croats returned home thanks to the Agreement on Succession Issues of the Former Socialist Federal Republic of Yugoslavia, SFRY, concluded in Vienna on June 29, 2001. Croatia, as a successor state of the former SFRY, needed to cover its inherited debt to Zambia.

After six months, Croatian citizens accused of human trafficking were acquitted due to lack of evidence by the Supreme Court in Zambia and arrived home like heroes, under special escort from government security.

Accompanied by the children from DR Congo they had adopted illegally.

Now there is silence, the kind of calm we often see before the storm. What the media tried to portray was a showdown between left and the right political options, but it was in fact a transnational organized crime.

Adoptions certified without any real checks

From the start, the validity of the documents on the adoption of children from the Democratic Republic of Congo was impossible because international adoptions from there have been completely prohibited since 2017.
Adoptions are also not allowed for homosexuals or transgender people both in the country and abroad.
When we talk about the network of illegal adoptions, they mostly consist of lawyers and corrupted judges.
So let’s see the modus operandi of illegal adoptions that took place in Croatia. On the basis of false documentation, issued in the DRC and submitted to the courts in Croatia, the adoptions were certified without checking the authenticity of the original documentation. At that moment, the false court decisions on adoption received from the Congo became official in Croatia. On the basis of them, the children could be registered and the Ministry of the Interior would issue the travel documents. After that, they would be transported via Zambia to Croatia.
It took me some time to explain to my Dutch colleagues and children’s rights experts that the Croatian courts did not verify the authenticity of the court decision on the adoptions from DR Congo, a country that is not a signatory to the Hague Convention. Such a scenario was impossible to them. It was also difficult to explain that those people who adopted children illegally were not registered in the Croatian register of adoptive parents, which is under the responsibility of the Ministry of Social Welfare. Thirdly, it is impossible to explain how the issuing of passports for children in the DR Congo was not done through diplomatic channels but via the Ministry of Interior in Croatia.
This meant that children could even be bought by people with a criminal record, or by pedophiles or people with mental difficulties. The children could also be located anywhere in Europe. You just need to pay from 15,000 to 40,000 dollars to get one.
The people who ordered these children were unhappy that they had to wait a month for the court’s decision. They found a court in Zlatar, which legalized a false court verdict from the DR Congo in one day. False verdicts from the DR Congo were verified on the same day or in just a few days in other courts, without checking the authenticity of the decision, or contacting the Ministry of Social Welfare or Foreign Affairs.
Nothing is written in the court explanations even though judicial reasoning is an integral part of a court decision, which every judge is obliged to present. The recognition of a foreign court’s decision cannot be justified only with one court seal, like in this case.

No one even seems to know the number of these adoptions

It is difficult to determine how many such children the Croatian courts have recognized over the past decade. The Ministry of Interior issued documents for 94 children, while the Minister of Social Welfare and Family, Marin Piletic, told the media that 131 children were adopted from the DRC. These numbers do not match.
According to the newly founded “Association of Adoptive Parents from DRC International Adoption – Croatia”, 104 children were adopted, plus four who live in three families outside Croatia. No one from Homeland Security has addressed the correct numbers, checked where these children are and in what conditions they live. Is the safety of African-origin children certified just with one seal less important than that of other children with Croatian documents? Why didn’t the police and social workers knock on the doors of the illegal adopters for seven months and count the children? What to hide, if everything is fine?
The owner of the orphanage where the Croats adopted the children, Emmanuel Kabongo, charges about $10,000 per child that someone can choose over a video. Extra costs go to lawyers, court interpreters, travel and accommodation, so the costs can go up to 40,000 euros.
Also, the payments have continued even after the Croatian parents went to Zambia to pick up the children who were supposed to arrive from the DRC. After the adoptive parents arrived at the hotel, they would take away their travel documents, both from them and from the children, under the excuse that they needed to arrange additional documents before bringing the children.
The parents were not able to refuse this; they had already invested too much. After that, these people would come back and ask for money for additional documents, usually costing about 2,000 US dollars, claims the person who witnessed it. “Extortion takes place very subtly”, but since they took away their travel documents, “there is no way for going back”.
This action was also confirmed in court on May 26 by the police officer who arrested the Croats at Zambia’s Ndola airport and testified that Steve Mulija, who prosecutors say was the mastermind of the Congolese child adoption operation, charged 2,040 dollars per child to transport them to Zambia from an orphanage in DRC.

Order, payment and delivery of children

Different experts have classified these violations differently. But one thing is clear: they violate the UN Convention on the Rights of the Child.  Roelie Post, who worked for 20 years in the EU Commission was direct with me: if it is an order, payment and delivery, as in this case: it is child trafficking and it is forbidden to trade with human beings. On the surface, it looks altruistic, people are adopting children and doing good by adopting those children, but that is part of the marketing used by the marketers.
If we look deeper, the adoption industry is full of people who make money off orphans who are not really orphans.
After receiving the order from parents, the agents and intermediaries order the “head-hunter” in the field to find a child for them to deliver. The motivation is often tempting – 10 to 15,000 dollars. Guided by this, they do not choose their means to get the child and may use fraud and even kidnapping.
Some adoptive parents I talked to told me that they knew that the children were not abducted because they regularly communicate with their parents in the DRC. Those people in the DRC, who claim to be the parents of the children, demand money from the adoptive parents, in this case, Croatian citizens, which can be seen as emotional blackmail. Are they really parents to these children?
In addition to the false documentation seen in the Croatian cases, there are also cases of children who are fraudulently separated from their parents in order to meet the demand for Western adoption. What is created is an industry, and the product are children. They are moved to the other side of the world, to a completely different culture, because someone, a consumer, wants a child. It has nothing to do with children’s rights. It has nothing to do with legal adoptions, either.
What is the message? By protecting crime, Croatia’s government has again undermined citizens’ trust in its institutions and constitution.
Aurora Weiss is a UN reporter and diplomat. She was educated and specialized at DA Vienna.
